WETLANDS PHOTO CONTEST

25 OCTOBER – 25 NOVEMBER 2018

1. TERMS

To celebrate World Wetlands Day on 2 February 2019, the Ramsar Convention Secretariat, hosted by IUCN, International Union for Conservation of Nature and Natural Resources, 28 rue Mauverney in 1196 Gland, Switzerland (hereafter the "Ramsar Convention Secretariat") is organizing a Photo Contest (hereafter the “Contest”). The Ramsar Convention Secretariat launches the competition on 25 October 2018 until 25 November 2018 12.00 Midnight CET. Information on how to enter and win the prize forms part of these Official Rules.

By submitting an entry (as defined below), each photographer (the "Photographer") accepts the Official Rules and warrants that his/her entry complies with all requirements set out hereunder.

2. WHO AND HOW TO SUBMIT

The Contest is open to anyone above 18 years old and all photographs for the Contest must be uploaded onto the World Wetlands Day Website link: www.worldwetlandsday.org

3. HOW TO ENTER

3.1. Each entry consists of:

i. an online Entry Form duly filled and submitted; and

ii. one photograph for the Contest (there is limit of one photographs per person, hereafter “the Photograph”),

(collectively, hereafter the "Entry”).

3.2. To enter the Contest, visit www.worldwetlandsday.org. The Photographer shall complete the Entry Form with the required information, and submit it along with the Photograph in accordance with the instructions that follow.

  1. The Photographer can submit an Entry in any of the 3 categories (each Photographer is limited to participate in a single category) namely;

i. Youth Category (Participants must be aged 18 to 25 years)

ii. Amateur Category

iii. Professional Category

 

3.3. There is no entry fees for the participation in this Contest, but miscellaneous fees for the entry including internet connection fees for upload are paid by the Photographer.

3.4. Each Entry must comply with all of the following requirements:

i. The subjects of the Photograph must be of any type of wetland. The Photograph can relate to or illustrate the beauty of wetlands.

ii. The Photograph must be in digital format. Only Photographs submitted online will be eligible. No print or film submissions will be accepted for entry into this Contest.

iii. All digital files of the Photograph must be in JPEG or JPG format, and with a maximum size of 5MB.

iv. The Entry, in its entirety, must be a single work of original material taken by the Photographer. By entering the Contest, the Photographer represents, acknowledges, and warrants that the submitted Photograph is an original work created solely by the Photographer, that the Photographer has all rights over the Photograph, and that the Photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any other person or entity, and that no other party has any right, title, claim, or interest in the Photograph. The Photograph must not, in the sole and unfettered discretion of the organizer or sponsors of the Contest, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.

v. By entering the Contest, the Photographer thereby agrees to abide by the Official Rules and grants the Ramsar Convention Secretariat the right to include the submitted Photograph in the Ramsar Photo Database.

3.5. The Photograph will be judged in accordance with the Judging Criteria, as defined below. All Entries must be submitted and received by 25 November 2018 at 12.00 Midnight CET

4. JUDGING AND CONTEST PRIZE

5. JUDGING

The Ramsar Convention Secretariat will set up a panel to judge the photo entries and select the winning photo.

5.1. The criteria for the Contest are:

1) Public votes 10%; (2) Technical quality 30%; (3) Artistic quality 30%; (4) Illustration of Contest theme 30%.

5.2. Decisions of the Judges are final and binding and no challenge or appeal of their decision by any Photographer shall be allowed.

6. PRIZE

6.1. There will be one winner announced for each category. One new Canon interchangeable lens digital camera will be awarded to each winner. (Models of the awarded digital cameras are solely determined by the organizer and the sponsor.) Winners' names will be posted on the Ramsar Convention Secretariat website (www.ramsar.org) and they will be sent a notification informing them that they have won the main prize.

7. INTELLECTUAL PROPERTY RIGHTS

7.1. Copyright of the Photograph remains with the Photographer. However, by entering the Contest, the Photographer grants a worldwide, irrevocable, perpetual license to the Ramsar Convention Secretariat the right to include his/her photograph(s) in the Ramsar Photo Database. The Ramsar Photo Database is a central pool of royalty-free photographs and illustrations, to be used on a royalty-free basis by the Ramsar Convention Secretariat and its partners in hard copy, electronic or other medium and for non-commercial purposes. The Photographer hereby grants to the Ramsar Convention Secretariat a royalty-free, non-exclusive license to copy, distribute or otherwise use the photograph(s) in the context of Ramsar Convention's statutory mission and objectives for purposes including but not limited to the Ramsar Convention Secretariat website and internal network system, projections, PowerPoint presentations, publications (periodicals, reports, newsletters, catalogues in hard copy or electronic media) and for press releases, featured articles and fact sheets, but not for private or commercial purposes.

7.2 Notwithstanding the foregoing, all Photographs submitted for the Contest will be used, in whole or in part and without compensation to the Photographer, at the discretion of the Ramsar Convention Secretariat in outreach products for the purpose of educating, raising awareness as well as promoting the wise use of wetlands in the regions around the world where the Ramsar Convention Secretariat is active.

7.3 Additionally, by submitting his or her photo to the Contest, the Photographer grants the Organizers the right to use his/her name, in promotional material and other publications.

7.4 The Photograph(s) will be posted with the following credit:

8. LIMITATION OF LIABILITY

8.1. By entering this Contest, all Photographers agree to release, discharge, and hold harmless the Ramsar Convention Secretariat and its members, partners, subcontractors, employees, officers, directors, and representatives from any claims, losses, and damages arising out of (1) their participation in this Contest or any Contest-related activities (2) the acceptance, use, misuse and/or possession of any prize awarded hereunder and (3) the Ramsar Convention Secretariat's use of the Photograph(s).

8.2. The Ramsar Convention shall bear no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft, alteration or destruction of, or unauthorized access to Contest Entries or Entry Forms. The Ramsar Convention Secretariat shall not be responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any emailed Entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to the Photographer's or any third party's computers related to or resulting from participation in, uploading or downloading Photograph(s) or other materials related to this Contest.

9. CONDITIONS

9.1. This Contest is void where prohibited by applicable law.

9.2. Entries shall be void if the Ramsar Convention Secretariat determines that the Photograph(s) is/are not an original, or if the Entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft. The Ramsar Convention Secretariat reserves the right to verify the validity and originality of any Entry and to disqualify any Photographer who submits an Entry that is not in accordance with these Official Rules or who fails to comply strictly with the Entry process. Failure by the Ramsar Convention Secretariat to enforce any of these or other rights at any stage does not constitute a waiver of those rights.

9.3. If the Photographer wins the Contest, then the Ramsar Convention Secretariat may use the winner's name and Photograph(s) in any publicity or advertising relating to the Contest or future promotions without compensation or approval by the Photographer (except where prohibited by law).

10. RAMSAR'S RIGHT TO CANCEL OR TERMINATE CONTEST

10.1. If, for any reason, the Ramsar Convention Secretariat determines that the Contest cannot be run as planned, for any reasons including but not limited to any cause beyond the control of the Ramsar Convention Secretariat that may adversely affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Ramsar Convention Secretariat reserves the right, at its sole discretion, to disqualify any Photographer(s) who fail(s) to comply strictly with the Entry process, and/or to cancel, terminate, modify, or suspend the Contest. If the Ramsar Convention Secretariat elects to cancel or terminate the Contest, the Ramsar Convention Secretariat will not retain any rights in the submitted Photographs which shall be destroyed.

11. DATA PRIVACY

11.1. Photographer(s) agree(s) that personal data, including but not limited to, name, date of birth, photograph and address may be processed, shared, and otherwise used for the purposes of and in connection with the Contest as outlined in these Official Rules. Photographer(s) further agree(s) that personal data may be transferred outside of Switzerland or to jurisdictions which may not offer adequate level of protection as in his or her country of residence. Personal data will be used by the Ramsar Convention Secretariat solely for the purposes stated herein and in accordance with the Privacy Policy accessible at (https://portals.iucn.org/dataprotection/privacypolicy).

12. DISPUTE RESOLUTION

12.1. These Official Rules shall be interpreted and applied in accordance with the laws of Switzerland. Any and all disputes that may arise under or in connection with those Official Rules, which have not been amicably settled, shall be finally settled in arbitration in accordance with the International Arbitration Rules of the Geneva Chamber of Commerce and Industry. The arbitration shall be conducted in Geneva, Switzerland, in the English language, and the award shall be final and binding on the parties.
